Terms and Conditions for Domain Services

Basic Provisions

These WEDOS Terms and Conditions for Domain Services (hereinafter the “DS Terms”) form part of the “General Terms and Conditions of Services of WEDOS, Internet a.s.” (hereinafter the “GTC”).
The application of these DS Terms takes precedence over the application of the GTC.
These DS Terms govern the registration, transfer, renewal, and changes of domain names held with the Operator, as well as the WHOIS Domain Privacy Protection service.
Registry means the organization entrusted with the administration and operation of the relevant top-level domain (TLD). The term Registry also includes the so-called Registry Backend.
If the Customer registers and manages domains in the name of a third party (the domain holder), the Customer is obliged to obtain that third party’s consent to these DS Terms and to any applicable rules of the relevant domain registry. Upon request, the Customer must provide evidence of this consent; otherwise the domain name may be cancelled without compensation.
The domain holder agrees that their personal data must be passed on to other persons if required for the administration of the relevant domain, and that their personal data must be published in the relevant registry information systems (WHOIS systems).
The Customer leases the domain name for use from the relevant registry, to which fees are paid for the lease of the domain. The Operator is the technical administrator of the domain, not its owner or payer.
Both the Customer and the domain holder agree to the rules of the relevant registry and the rules of the relevant TLD.
The Customer is obliged to ensure that the domain contains correct and up-to-date information about the domain holder and other contacts, and any other information required by the relevant registry. Otherwise, the Customer risks the domain being cancelled due to incorrect information, without any entitlement to a refund of funds or compensation for damages incurred.
The Operator is entitled, if necessary, to communicate regarding the domain directly with its holder.
At the request of the domain holder, the Operator may remove the domain from the Customer’s account and place it under the direct administration of the holder. In such a case, the Customer is not entitled to a refund of any fees for the unused period of the domain.
The Operator offers various add-on services for domains. An overview of these add-on services is always provided in the current domain name price list or related documents. The Operator is entitled to change the price of add-on services at any time with immediate effect.
The Operator is entitled to change the price for registration, renewal, transfer, or other similar operations with domain names as of the following prepaid period, i.e., from the time of the next renewal of the service.

Domain Registration

The ordered domain will be submitted for registration only after payment of the relevant fees according to the current price list and fulfillment of any other conditions required by the Operator or the relevant registry for the given TLD.
Placing or paying for a registration order does not entitle the Customer to the given domain name. Such entitlement arises only after the registration has actually been carried out and confirmed by the Operator.
The Customer acknowledges that the Operator may require the domain holder to provide additional documents or other particulars necessary to carry out the domain registration, in accordance with the conditions set by the relevant registry for the specific TLD. This may include personal data (birth number/personal ID number, ID card number, date of birth), the provision of a notarized document, sending a copy of a personal ID document, agreement to additional terms, etc.
Domain registration will only be carried out if:
– the relevant registry permits the registration of the given domain name
– at the time of registration, the domain name is freely available for registration and is not blocked, reserved, or prohibited in any way
– the applicant for domain registration has fulfilled all conditions set by the relevant registry
– the relevant registry is fully functional and successfully confirms the domain registration
The domain name that the Customer wishes to register cannot be reserved or blocked in any way by placing an order. If another party interested in registering the same domain name fulfills all the requirements for registration earlier, the domain cannot be registered for the Customer.
The Operator is not liable for any damages caused by the inability to register the domain.
If the conditions for carrying out the domain registration are not met, the order is cancelled after 30 days, and any fees already paid are refunded to the customer, provided the status of the order allows it.
The Operator does not check or verify the legitimacy of the Customer’s request to register the given domain name and bears no legal responsibility for it. The Customer is responsible for any problems or damages caused by a conflict with trademarks, a court decision, or other obstacles that prevent the Customer from using the domain name.
Likewise, the Operator does not check whether all non-technical requirements for the registration of the domain name have been met, in particular compliance with various rules (for example, additional individual rules of the registry for the given TLD). In the event of non-compliance, the domain name may be cancelled without compensation.

Domain Expiration and Renewal

The Customer is obliged to pay the fees in time and fulfill any other requirements for renewing the domain’s validity for the following period.
If the customer fails to fulfill all the requirements (in particular payment of the fees for the following period and acceptance of the rules) for renewing the domain more than 14 days before its expiration, the Customer and the domain holder risk cancellation of the domain. The Customer also acknowledges that, for some TLDs, failure to renew the domain may result in the original content becoming unavailable after expiration.
The Customer is obliged to independently monitor and keep track of the expiration dates of their domains. The Operator informs the Customer of an upcoming expiration, but is not obliged to do so. The Operator is not liable for damages caused by the domain expiration notice not being delivered to the Customer.
The domain will be renewed for the following period only if:
– the customer has fulfilled all requirements for renewing the domain sufficiently in advance of its expiration
– the relevant registry permits the renewal of the domain
– the relevant registry is fully functional and successfully confirms the domain renewal
– the domain has not already been cancelled due to failure to renew it in time
If the Customer does not respond to the domain expiration notice, the Operator is entitled, but not obliged, to inform the domain holder directly.

Domain Transfer

The ordered domain transfer will only be carried out if the Customer and the domain holder fulfill all requirements required by the Operator or the relevant registry for the given TLD. For some TLDs, the transfer requires payment of an administrative fee, a fee for operating the domain for the following period, entry of an authorization code, or approval of the transfer by another method.
The domain transfer will only be carried out if:
– the relevant registry permits the transfer of the given domain name, and the domain transfer or changes to the domain are not restricted or blocked in any way
– the applicant for domain registration has fulfilled all conditions set by the relevant registry
– the relevant registry is fully functional and successfully confirms the domain transfer
The Operator is not liable for any damages caused by the inability to transfer the domain.
If the conditions for carrying out the domain transfer are not met, the order is cancelled after 30 days, and any fees already paid are refunded to the customer, provided the status of the order allows it.

Changes to the Domain

All changes to the domain must be properly authorized by the Customer, i.e., the Customer must verify their identity using the relevant login credentials.
The Operator may require additional authorization (for example via email, SMS, or by sending documentation) for certain changes.
Any changes to domains may be subject to a fee charged by the Operator according to the current price list or by agreement between the Customer and the Operator.
The domain change process will only begin after payment of any applicable fee and after fulfillment of all other requirements set by the Operator or the registry for the given TLD.
Changes to the domain can only be made if the status of the domain allows it and the registry permits such a change.

Cancellation of Domain Requests

Cancellation of a request means a request by the Customer or the domain holder to cancel or suspend an ongoing registration, transfer, renewal, or other change to the domain.
If the situation allows, such a process may be stopped. The customer’s request to cancel a request may be subject to a fee charged by the Operator according to the current price list.
If the action can no longer be reversed, the Customer cannot claim a refund of the fees associated with the given request.
It is not possible to cancel changes to domains once they have already been made. In such a case, the Customer must request that the change be reverted to the original details or status, and pay again any fees associated with such a change.
The domain registration or renewal process does not allow for a refund of fees for already registered domains, and the customer acknowledges and agrees that the statutory conditions for withdrawal from a distance contract (a contract with a consumer concluded remotely under the relevant legal regulations) do not apply to domain registration or its renewal. The Customer therefore cannot withdraw from the domain registration contract if the domain registration was carried out before the expiration of the consumer’s withdrawal period under the applicable special legal regulation.

Operation and Use of the Domain

The Customer is fully responsible for how their domains are used and what websites and other services are operated on them.
In the event of a court (or other similar) dispute regarding the domain, the Operator may, on the basis of a court order or decision (of a similar nature), prevent the Customer from using the domain or carry out the ordered changes. In the event of an ordered change of holder to another person, the Customer is not entitled to a refund of any fees for the unused period of the domain’s validity. Likewise, the Customer is not entitled to compensation for any damages caused by the restriction of the domain’s use or by ordered changes to the domain.

DNS

The Customer is responsible for correctly configuring the DNS records on the authoritative DNS servers for the given domain.
The Operator offers, free of charge, the hosting of domain DNS records on its own DNS servers for domains held with the Operator (as registrar) that also use other services offered by the Operator (for example webhosting or virtual or dedicated servers).
The Operator is not liable for any problems caused by a malfunction or unavailability of the Operator’s DNS system.
The Operator is entitled to delete the domain from the DNS system if the domain has not used the Operator’s DNS servers for a period of 60 days.
The Operator offers the use of DNSSEC technology only for domains for which it is the registrar, and only in the following 2 variants:
– the domain uses the Operator’s DNS servers, records are signed with the Operator’s DNSSEC keys, and the Customer cannot use their own key
– the domain does not use the Operator’s DNS servers, and the Customer must use their own DNSSEC keys
The Operator is not liable for any problems caused by incorrect configuration or a technical malfunction of DNSSEC technology.

WHOIS Domain Privacy Protection

The Customer is entitled to order the WHOIS Domain Privacy Protection service for their domain name, which allows the Customer’s registration details to be hidden from the public. The extent to which individual details are hidden varies depending on the available options and the selected service variant.
The WHOIS Domain Privacy Protection service is charged according to the current price list. The available variants are described in their current form on the Operator’s website.
The Operator is not liable for any problems caused by hiding the details from third parties.
The Operator offers this service only for certain domain endings (TLDs), in accordance with the rules of the relevant domain registry. If the domain registry’s rules change such that it is no longer possible to use the WHOIS Domain Privacy Protection service, the customer will be promptly informed of this fact, including the procedure (plan) for how the service will be cancelled. In this case, the customer will be refunded the amount for the unused period (the proportional amount rounded to whole months).
The WHOIS Domain Privacy Protection service is offered as an add-on service for domain names and can be activated at any time. This add-on service can be activated immediately during the order of a new domain or the transfer of an existing domain to the Operator, or for an existing domain already held with the Operator (where the Operator is the registrar).

Customer Support

Customer support for domains is provided only through the community forum, or, in urgent cases, through tickets from the Customer Administration, on business days between 8:00 AM and 4:00 PM CET (GMT +1). Outside this time, proper renewal of the domain or resolution of administrative or technical problems with the domain cannot be guaranteed, including those that may or do have a direct impact on the domain’s functionality.
Other types of support can be purchased for domains according to the current offer provided by the Operator.

Duration of the Agreement and Its Termination

The Agreement is concluded for a fixed term of a minimum of 1 year and a maximum of 10 years. The specific duration of the Agreement is determined by written agreement of the contracting parties, or automatically by the Customer’s choice of billing period length when ordering the service, in which case the duration of the Agreement is automatically agreed to be the same as the length of one billing cycle.
Based on a request with a notarized signature, delivered by the Customer to the Provider in writing, the Operator will delete the domain. Deleting the domain does not give rise to any entitlement to a refund of the amount already paid (not even on a pro-rata basis).
Deletion of domains under the preceding paragraph is subject to a fee according to the current price list.
