General Terms and Conditions of Services
Basic provisions:
- These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the contractual relationship between the Provider of internet services and the Customer.
- The Provider of internet services (hereinafter referred to as the “Services”) is the company WEDOS, a.s., Company ID 28115694, with its registered office at Masarykova 1230, Hluboká nad Vltavou, 373 41, registered in the Commercial Register maintained by the Regional Court in České Budějovice in Section B, Insert 1887, and WEDOS Internet, a.s., Company ID: 28115708, with its registered office at Masarykova 1230, 373 41 Hluboká nad Vltavou, Czechia, registered in the Commercial Register maintained by the Regional Court in Section B, Insert 1886, or other companies belonging to the WEDOS group.
- Other companies belonging to the WEDOS group means all business companies with a similar shareholder structure, or other WEDOS business companies belonging to the group financially connected with WEDOS Internet, a.s., including subsidiary or sister companies. As the list of these companies may change over time, they are declared only in general terms. A list of the specific companies is always provided in its current form on the WEDOS website together with these GTC. The Provider is one of the companies of the WEDOS group. The specific legal relationship of a specific company towards the Customer is determined (for paid services) by the fact of who issued the tax document for the services provided to the Customer. If no invoicing has taken place, the Provider is always the company WEDOS, a.s., Company ID 28115694, with its registered office at Masarykova 1230, Hluboká nad Vltavou, 373 41, registered in the Commercial Register maintained by the Regional Court in České Budějovice in Section B, Insert 1887.
- The Customer is a legally competent natural person or a legal entity that concludes a Contract with the Provider. The Contract is concluded by completing and submitting an order for one of the offered services on the website or via the Provider’s API (Application Programming Interface) and, at the same time, by duly paying the amount according to the current price list, or by setting up the service if it is a free service. By ordering a service, the Customer expresses consent to these General Terms and Conditions (GTC). Upon ordering, the Customer receives login credentials to the WEDOS customer account from the Provider. A Customer – consumer means a legally competent natural person who concludes a Contract with the Provider for their private, non-business purposes.
- The Customer administration means the pages at the address “client.wedos.com”, where the customer can manage their services with the Provider after logging in.
- Authorization means proving the identity of the customer, in particular by presenting the login name and password to the Customer account, and thereby also proving the right to manage the customer account and the services maintained under it. The Provider may require another method of authorization from the Customer.
- The Customer acknowledges and agrees that they are not entitled to conclude a Contract with the Provider and to order services offered by the Provider on behalf of third parties unless the third party has given them prior written consent to do so. This written consent may be requested by the Provider at any time and the Customer is obliged to submit it without delay, otherwise the Provider is entitled to cancel the ordered service.
- By ordering a service, the Customer expresses their unambiguous consent to and understanding of the Contract, these GTC and all other terms related to the ordered service, as well as the content, specification and price of the service they ordered according to the Provider’s offer. Both the Customer and the Provider are obliged, throughout the duration of the Contract, to comply with generally applicable legal regulations, the provisions of the Contract, these GTC and other terms if they are part of the service ordered by the customer.
- By concluding the Contract, the Customer also declares that they have become acquainted with the functions of the given service and, for that reason, is not entitled, within the framework of the provided service, to demand a refund of a payment already made for any of the offered services on the grounds that the kind, type and design of the service does not suit them. This can only be replaced by a mutual agreement of the contracting parties prior to the conclusion of the Contract, whereby this agreement must be in written form. For certain selected services, the Provider offers a 7-day money-back guarantee, whereby this information is visibly stated for the relevant service.
- The Customer is fully liable for any damage caused by their conduct in breach of these GTC and/or the legal order of Czechia to the Provider, to other users of the Services or to other third parties. This liability cannot be waived.
- In the event that the Customer breaches these GTC (or other related terms for a specific service), the Provider is entitled to suspend their Services. In the case of a particularly serious breach or repeated breaches of these GTC (or other related terms for a specific service), the Provider is entitled to cancel the service. The assessment of whether these GTC (or other related terms for a specific service) have been or are being breached is at the Provider’s discretion.
- Suspension of a service means disabling the given Service and/or preventing access to the given Service. At the same time, the Customer has no access to any data (files, databases) belonging to the Service. Operation can only be restored by remedying the defective state, extending the validity of the Service or paying a fee for restoring the data from a backup.
- Cancellation of a service means its suspension, termination and deletion of the data of this service. The process and timing of the Cancellation of a service, i.e. possible suspension, termination and deletion, differ for individual services. The Provider always provides a current overview on its website, either in the description of the individual offered services or as part of the description of the service cancellation process.
- An integral part of these General Terms and Conditions are the partial documents governing the terms for the individual types of offered services: – Contractual Terms of WEDOS Domain Services (DS Terms) – Contractual Terms of WEDOS Hosting and Cloud Services (HCS Terms) – Contractual Terms of the WEDOS OnLine Monitoring Service (WO Terms).
- Unless expressly stated otherwise on the product page of the individual services in the offer and description, customer data is located within the territory of the European Union (EU), in particular within the territory of Czechia. By the nature of some of the services provided by the Provider (for example DNS, WEDOS OnLine, etc.), some partial data is also stored on these Provider servers outside Czechia and the EU. This fact is always expressly stated for the relevant service.
- The Provider has the right to publish the logo of its Customer, and possibly also basic identification data (for example first name, surname, company name, address) on its website, the social networks it uses or in advertising materials for the purpose of promotion and use as a reference customer. The Provider has the right to publish a graphic preview of the work created by the Customer for the purpose of promoting one of the services offered by the Provider.
- The Customer is obliged, upon each change, to update their identification, billing and contact data provided when ordering the service and recorded within the Customer’s account in the Customer administration, no later than 7 days from the moment the change occurred. The Customer updates the contact data in the Customer administration. The Provider may change the data on behalf of the Customer only on the basis of a request from the Customer sent in the form of an Authorized request or in the form of a written request with a verified signature. In the event of failure to fulfil the updating obligation, the Customer bears full responsibility for any resulting damage.
Service availability guarantee, faults and outages
- The Provider ensures trouble-free operation of the services with the exception of the time necessary for the maintenance of the technical and software resources through which the services are operated.
- The Provider is entitled to carry out planned outages of the systems for the purpose of their maintenance and updates.
- The Provider is entitled to carry out unplanned outages if the situation requires it and it is necessary to carry them out without delay in order to ensure the continued operation of the services and servers.
- A fault means an error in the Provider’s technical or software resources that causes complete non-functionality or unavailability of the services, as a result of which the Customer cannot fully use them. A planned or unplanned outage is not considered a fault.
- The Provider is not liable for the non-functionality or unavailability of a service that is caused by a third party. The Provider is not liable for the non-functionality or unavailability of a service that is caused by the Customer.
- The Provider bears no responsibility for the non-functionality or unavailability of the system that was caused by a technical or other problem on the part of a subcontractor, by a fault or outage in the Internet network between the user and the Provider’s servers, or by force majeure. The Provider bears no responsibility for the unavailability of the service in the event of a malfunction of the user’s connection to the Internet.
- The Provider bears no responsibility for the interruption of the provision of Services to the Customer under these GTC and/or the Contract in the event of intervention by third parties or force majeure (in particular flood, fire, wind, war, earthquake, etc.) or in the event of a fault in the equipment of third-party suppliers (in particular an extensive and long-term outage of the electricity supply, telecommunications connection, etc.).
- None of the offered services provides detailed proprietary monitoring of a public nature. The Provider is obliged to inform the Customer about all faults, outages and important changes on its WWW pages (in particular in the customer administration – client.wedos.com and on the status page vedos.status.online) as far as possible sufficiently in advance.
- The Customer has no claim to compensation for damage or other costs incurred in connection with the unavailability of the service or the loss (damage) of data or a fault of another nature. Any compensation for damage and other costs, including liability for the Customer’s lost profit, is always limited (and capped) to a maximum amount equal to the fee for one month of operation of the relevant service. Different claims for compensation of damage may be drawn up in advance and only in the form of a written agreement or an amendment to these GTC.
- In the event of non-functionality or a fault of the service, the Customer is obliged to file a complaint about the defect in writing (by e-mail, contact form) no later than 24 hours from the beginning of the non-functionality of the service.
- The Customer has no claim to any compensation on account of a service fault in the event that they have not duly and timely paid all fees for all services provided by the Provider, the service has been terminated, or the service is non-functional due to the Customer’s prior conduct, or the Customer does not, in a demonstrable written manner (by e-mail, contact form), file a complaint about the non-functionality of the service no later than 24 hours from the beginning of the non-functionality of the service.
- Given the nature of e-mail communication, the Provider does not guarantee the correct delivery of e-mail messages from its servers or to its servers and from/to its network, and bears no responsibility for any damage caused by an undelivered or lost e-mail message. Similarly, the Provider does not guarantee incorrectly stored or uploaded or otherwise created data serving for any services provided by the Provider.
- The Provider is not responsible for the loss or damage of any data as a result of a software or hardware failure of the server or disk array (for example a hard disk failure). It is the duty of all customers to prevent damage, and therefore the Provider strongly recommends that all customers carry out their own backup of all data to the extent at the customer’s discretion.
Customer support and communication with the customer
- The scope and conditions of providing customer support are specified in detail in the terms of the individual services. The scope and conditions of support differ for individual services and the Customer can choose the variant that suits them.
- When contacting customer support, the Provider may require the Customer to prove their identity with the login credentials to the WEDOS customer account or with other identification data established for this purpose (Authorization). If the Customer fails to do so, the Provider may refuse to provide support or to carry out an intervention by a Provider technician. The Provider reserves the right to additional authorization in the event that it suspects a compromise or misuse of the customer account or of the Customer’s login credentials to any of the Provider’s systems.
- Within the framework of customer support, the Provider provides the Customer with basic information, guides and advice through its website, which relate exclusively to the service (not to its content). Other methods of support and assistance are always precisely stated for the individual services. If the Customer requests that the Provider solve a problem that requires the intervention of a Provider technician and that was caused by an error on the part of the Customer, or as a result of improper use of the Service, the Provider may require the Customer to pay for the technician’s intervention according to the current price list.
- If support by telephone is available for a service, only general information and advice can be obtained by telephone, or evident faults or deficiencies of the service can be resolved. However, it is not possible to request via telephone the performance of actions that require customer authorization. In such a case, it is necessary to fill in the relevant form and open a ticket on the Provider’s website after logging in to the customer account.
- The Provider bears no responsibility for the content of the information (including texts, images, videos) provided on the community website help.wedos.cz (or other language versions). Likewise, the Provider bears no responsibility for the up-to-dateness of the information provided on the website kb.wedos.com (or similar Provider websites).
Billing and payments
- The current price list is available on the Provider’s website “vedos.cz”, or on other Provider websites containing official descriptions and presentations of the individual services. On these Provider websites, the individual language versions may contain various combinations of currencies and languages. Prices in the individual currencies may differ, regardless of the current exchange rate. The Provider announces changes in the price list in time (and sufficiently in advance) on the same pages.
- Invoices and proforma invoices are sent to the Customer by electronic mail to the e-mail address stated in the Customer’s WEDOS customer account. Accounting documents are not provided in paper form, to which the Customer expressly agrees. Sending accounting documents in paper form is possible for a surcharge according to the Provider’s price list.
- Invoices for one-off technician actions are payable in advance, or within 7 days of the invoice being issued and sent to the Customer. In the event that the setup or launch of the service depends on the payment of the invoice, the invoice is payable immediately. The service will be provided after the payment has been made and the funds have been credited to the Provider’s account.
- If the Customer fails to pay any proforma invoice (payment request) by the end of the prepaid period of the given service, the Provider is entitled to suspend the service.
- If the Customer fails to pay any invoice duly and on time by its due date, the Provider is entitled to suspend the service.
- If any invoice or proforma invoice remains unpaid for 3 calendar days after the end of the prepaid period of the given service, the Provider is entitled to permanently cancel the service. In such a case, the Customer’s data will be irretrievably deleted. In the event that the customer wants to get this data back (if the Provider has it available in a backup), or to restore the service, the Provider is entitled to require payment for this service according to its price list.
- A service that the Provider or the Customer has terminated (used the so-called Run-out of the service in the administration) may be completely cancelled by the Provider immediately after the end of the prepaid period or immediately after the date of the agreed termination.
- Non-payment of an invoice or proforma invoice has no effect on the prepaid period. The Customer is obliged to pay for the operation of the service even for the time when it was suspended by the Provider.
- Invoices and proforma invoices are considered paid upon the fulfilment of all of the following conditions:
a) the payment is sent to the correct account of the Provider
b) the exact (non-rounded) amount according to the payment request is remitted in the correct currency
c) the correct variable symbol is stated with the payment
d) the payment is credited to the Provider’s account
e) the payment is processed by the Provider’s payment system - The Provider does not accept written, fax, e-mail or any other similar confirmations of payment if the amount has not yet arrived in the Provider’s account.
- In the case of an international payment, the Customer is obliged to pay all fees associated with foreign payment transactions (setting the fees to “OUR”). Otherwise, the provider does not accept the payment and the Customer is obliged to make up the difference so that the amount arrives to the Provider in the full required amount.
- All discount coupons, unless stated otherwise, are valid only for newly ordered services and only for the first billing period. They do not apply to the renewal of services, likewise they do not apply to top-up invoices and to the payment for additionally activated surcharge services. Discount coupons cannot be combined or added together in any way. Discount coupons cannot be applied retroactively (after the order is paid). Discount coupons cannot be applied after the expiry of their validity (or the exhaustion of another restriction), nor can any compensation be claimed for unused coupons. The application of a coupon means the issuing of an order – its later cancellation or change has no effect on the invalidation of the coupon (e.g. a coupon for 1 use stops working when the customer creates an order that they later cancel; a coupon used in this way will no longer work).
- In the event of the necessity of refunding an unused payment to the Customer (for example from a deposit account), payments are refunded in the same way they were received (for example, in the case of payment by payment card, the payment is refunded to that payment card, or in the case of payment from a bank account, the payment is refunded to the same bank account from which it was received). If an agreement is reached between the Provider and the Customer and the payment is refunded in another way, the Provider is entitled to additionally identify and verify the identity of the payment recipient and may charge a fee according to the agreement for refunding the payment in another way. If it is not possible to refund the unused payment in the same way and no agreement is reached or the new recipient is not identified, the Provider is entitled to refuse the refund of the payment.
- The Customer agrees that handling fees may be charged for selected types of payments, in accordance with the Provider’s price list. This is in particular due to the administrative complexity of processing some payments or their high financial demands (high fees).
- The Customer understands that various third-party payment systems (for example payment gateways) are used to receive payments.
- At the same time, the in-house payment system WEDOS Pay is used to receive payments from Customers, which is operated by the subsidiary company WEDOS Pay, s.r.o. (or another company serving a similar purpose), for receiving payments for all companies belonging to the WEDOS group. This payment system functions as an intermediary of payments between the Customer and the Provider and, at the same time, may use various third-party payment systems (for example various payment gateways).
- The WEDOS Pay payment system may also, if the Customer is interested, be used as a so-called wallet, where the customer has their funds stored for future payments for the Provider’s services (or those of all companies included under the WEDOS group). These funds are maintained as non-purpose-specific deposits for the payment of services provided in the future. From this virtual wallet, the Customer can make individual payments for any services offered by the Provider or other companies of the WEDOS group. Individual requests create a so-called blocking of funds in this wallet, and these funds are once a month (at the end of the calendar month) charged and billed to the customer with a summary tax document. The funds in this wallet do not bear any interest, nor are any fees applied to them, except for fees for the exchange of various currencies within the same account. The Customer may at any time request the withdrawal of unused, uncharged and unblocked funds. The Provider is obliged to refund these funds to the Customer no later than 30 days from receiving the authorized request. The refund is governed in the same way as stated in the preceding paragraphs. A so-called deposit account is handled similarly to this wallet.
Rights and obligations of the Provider
- The Provider is not liable for any infringement of trademark rights, business name rights and other rights protected by generally binding legal regulations, committed by the Customer through the use of the services.
- The Provider is not liable for any damage or loss that has been or could be caused to the Customer in connection with the use of the services. Any compensation for damage and other costs, including liability for the Customer’s lost profit, is always limited (and capped) to a maximum amount equal to the fee for one month of operation of the relevant service. Different conditions can be agreed only in the form of a written agreement between the Customer and the Provider.
- The Provider is entitled to change the parameters of the services and their variants. However, it is obliged to announce these changes to the Customer in advance and sufficiently ahead of time in the form of information on the Provider’s website.
- The Provider is not entitled to interfere with the data created or placed by the Customer, unless otherwise agreed between them. This prohibition does not apply in the case of suspicion concerning a breach of these contractual terms and misuse of the provided service. The Provider is obliged to immediately inform the Customer about this.
- In the event that the Customer breaches these Contractual Terms or other arrangements with the Provider, the Provider is entitled to unilaterally withdraw from the Contract and cancel the provided service. In such a case, the Customer’s data may be deleted and may be stored on a substitute medium. In the event that the Customer wants to get this data back, the Provider is entitled to require payment for this service according to its price list.
Rights and obligations of the Customer
- The Customer is obliged to use the services according to the manuals, guides and instructions supplied by the Provider. They are also obliged to train, in this sense, everyone who participates in the administration of the services.
- The Customer undertakes to take, on their part, all measures needed to prevent the misuse of the services. The Customer is responsible for the consequences of such misuse if it occurs.
- The Customer is obliged to take all measures to protect all access credentials (login name and password) of all users for the administration and use of the services and for access to the customer account. The Customer is responsible for any damage that arises from the misuse of the system by an outside person who uses the correct login name and password for access.
- The Provider is in no way responsible for the misuse of the Customer’s login credentials or the personal data of the Customer or third parties, on the basis of which it received and accepted an order for a service or performed any requested change or modification of already existing data and Services, provided that this misuse was not caused by the Provider itself. Sending them to the Customer at the Contact address stated by them, before and/or after setting up the Service, or resending them to the Customer after the Customer requests their repeated communication, cannot be considered misuse of this data on the part of the Provider. The Provider is entitled to change the access codes for an urgent technical reason even without the Customer’s consent, provided that this measure is necessary for the proper provision of the Services.
- By submitting an order (and the relevant checkbox option there), the Customer agrees that the Provider will send them, by e-mail, information about news in the Provider’s service offer. Cancellation of the sending of these e-mails is possible in the Customer administration of the specific Customer.
- The Customer is prohibited from attempting to disrupt the operation of the services and the technical or software resources, deliberately overloading them, attempting to use the services or systems contrary to their purpose even if doing so in good faith (for example penetration tests, benchmarks, etc.) without the Provider’s consent.
- The Customer is prohibited from using the services for purposes that are contrary to the laws of Czechia or contrary to good morals and generally recognized moral and ethical standards. In particular, the Customer must not infringe the legally protected rights of the provider and of third parties.
- The Customer guarantees to the Provider the correctness and completeness of the data provided in the registration, in all order forms and other documents. At the same time, the Customer is obliged to immediately update all changes or report their change to the Provider. The Provider is not liable for any damage caused as a result of stating invalid or outdated data. The Customer is obliged to state true and complete data in the order and the subsequent records maintained by the Provider. Without stating true and complete data, the Provider is entitled to suspend the service at any time without warning or to cancel it without compensation.
- The Customer will find all information and procedures for the Operational security of administration in cloud computing, such as for example damage caused by an accidentally deleted virtual server or dozens of servers, but also procedures for restoring or terminating the service, in the knowledge base or on the product page of the specific service. In the event of a query from the Customer, the information will be clarified. In order to avoid administrative overload of the organization (for example for repeated or unjustified requests), WEDOS may charge the Customer for this clarifying information according to the price list.
- The Customer will find all information and procedures about Critical activities in cloud computing, such as the installation, editing, deletion of a virtual device (servers, networks, storage) and also procedures upon the termination of a cloud service or for example procedures for restoration and backup, in the knowledge base or on the product page of the specific service. In the event of a query from the Customer, the information will be clarified. In order to avoid administrative overload of the organization (for example for repeated or unjustified requests), WEDOS may charge the Customer for this clarifying information according to the price list.
Exclusion from operation
- The Provider may refuse to provide services to a Customer whose activity at least partially falls, for example, into one of the following categories, or whose content that they provide, store, share or download at least partially falls, for example, into one of the following categories:
– it is contrary to the legal order of Czechia or to valid international conventions
– it is contrary to good morals
– operating any system that may be misused to commit criminal activity
– infringement of copyright, patent, industrial or other similar rights
– sending unsolicited messages (spam)
– direct or indirect harm to any rights of third parties
– overloading the infrastructure or the technical or software resources of the Provider or other parties
– endangering the privacy or security of other systems or persons - The above provision concerns everything that can, even partially, be classified into the above categories, whereby the decision on a breach of this paragraph on the part of the Customer is exclusively at the Provider’s discretion.
- The Customer is not entitled to store or share programs or data (files) of which they are not the author and for the handling of which they do not have the written consent of the author or the owner of the rights to them. In the event of suspicion of a breach of this prohibition, the Provider is entitled to request from the Customer a written confirmation that they are entitled to do so. The Customer is obliged to supply this confirmation to the Provider without undue delay. If the Customer does not supply this confirmation, the Provider is entitled to restrict or suspend the service or to delete the disputed data (files). The decision on the compliance of the use of the service with these contractual terms is exclusively at the Provider’s discretion.
- The Provider is entitled to examine the customer’s data (files) if it forms a suspicion that this data (files) is contrary to these terms.
- The Customer is liable for all damage caused to the Provider, to its other Customers or to third parties. In the event that the customer damages the Provider’s name, or in any way attempts to damage the Provider’s name, the Provider may immediately cancel their services and claim compensation for damage in the amount that the Provider quantifies.
- The Provider will allow the placement of content with erotic and pornographic themes on its equipment only after prior agreement between the Customer and the Provider. Without this agreement, the placement, distribution and downloading of such content is prohibited.
- The Provider is entitled to restrict the operation of a service in the event that the Customer uses unsuitable software resources for their operation or they are not suitably configured (e.g. an error in a script, an unsuitable algorithm in a program, incorrectly set database indexes, etc.). The decision on unsuitability is exclusively at the Provider’s discretion.
Protection of information and protection of personal data
- Both the Provider and the Customer undertake to maintain confidentiality about facts that they learned from each other in connection with the setup and operation of the services. The confidentiality obligation does not apply to the provision of information to subsidiary companies, parent companies or affiliated companies, or to legal or accounting advisors and auditors, whom the contracting parties must bind to maintaining the same degree of confidentiality.
- The protection of information does not apply to the case where the Provider has an information obligation established by law, i.e. where state authorities authorized to do so by law request the information, or where it concerns information that is publicly available.
- Details regarding personal data, the handling of personal data and the protection of personal data are in a separate document Principles of Processing the Personal Data of WEDOS Customers in Compliance with the GDPR.
- In the event that the Customer stores (keeps) any personal data with WEDOS, a Processing Agreement is concluded between WEDOS and the Customer, according to which the Customer is the controller of this personal data and WEDOS is the processor. A similar procedure applies in the event that the Customer already acts as a processor of personal data for another controller. In such a case, WEDOS is an additional processor. The Processing Agreement is available for download in the client administration for selected services.
- The Provider undertakes to secure the protection of personal data against unauthorized or accidental access, to prevent its alteration, loss or destruction, unauthorized transfer or its other unauthorized processing, as well as other misuse.
Duration of the agreement and its termination
- The duration of the agreement and its termination are governed by the contractual terms of the specific services.
- The Customer – consumer has, in accordance with the provision of Section 1829 of Act No. 89/2012 Coll., the Civil Code, the right to withdraw from the Contract within a period of 14 days from the day of its conclusion. Given that the Customer – consumer expressly requested the Provider to commence the provision of services before the end of the period for withdrawal, they acknowledge that they are obliged to pay the Provider a proportionate part of the agreed price for the performance provided up to the moment of withdrawal from the Contract. The customer may withdraw by filling in the relevant form in the relevant customer section on the Provider’s website.
- Upon the termination of the operation of a service, the Customer’s obligation to pay unpaid invoices and proforma invoices does not cease, with the exception of a proforma invoice for a prepaid period that has not begun.
- The Provider is entitled to terminate the provision of existing services due to the introduction of new services, a change of the provided services, a change of market conditions, the development of new technologies, etc. The Provider undertakes to replace services whose provision is to be terminated with other similar services, if it is technically possible and economically reasonable. The Provider informs the Customer about such a change in the form of a Notice a reasonable period of time in advance. If the Customer does not decide to choose another alternative service from the Provider’s offer, the provision of the existing service will be terminated with a one-month notice period. Unused funds for the remaining period will be refunded to the Customer in the form of a credit note from the Provider, no later than 30 days from the termination of the provision of the service.
- The contracting parties may terminate the contractual relationship by mutual agreement or by unilateral notice. The notice period is 1 month and begins to run from the day following the delivery of the notice to the other contracting party. Notice given by the Customer does not give rise to the Customer’s claim to a refund of any funds, i.e. not even, for example, unused funds for the remaining (unused) period of the prepaid service.
Final provisions
- All arrangements between the Provider and the Customer are governed by the valid and effective Czech legal order.
- In the event that a change of jurisdiction were to occur, the Provider will inform its customers about this change without delay, no later than 1 month after this change.
- With regard to the fact that the contractual relationship is established for a longer period, and during this period changes in the market or legislation may occur, the Provider reserves, within the meaning of Section 1752 of Act No. 89/2012 Coll., the Civil Code, the right to change these GTC to a reasonable extent. The Provider will publish the new wording of the GTC on its WWW pages and the Customer will be notified of such a possible change by e-mail, a reasonable period of time before the new GTC come into effect. The Customer has the right to reject the changes to the GTC in writing, no later than the day on which they come into effect. In the event that the Customer does not reject the changes to the GTC during this time, it is deemed that the contractual relationship is governed by the new wording of the GTC. In the event that the Customer rejects the changes/new complete wording of the GTC, both the Provider and the Customer are entitled to prematurely terminate the relevant contractual relationship, by mutual agreement or by notice. The notice period in such a case is 2 months from the written notification about the change to the GTC to the other contracting party.
- In the event that these GTC are available to the Customer in several language versions, the Czech version takes precedence. In such a case, the Provider is not liable for the correctness of such a translation.
- These GTC come into effect on 1 April 2021
